1. Acceptance of Terms

By accessing or using the Building Physics Australia website and services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you should not use our services. These terms apply to all users, including visitors, customers, and anyone accessing our digital products or booking consultations.

2. Services Description

Building Physics Australia (ABN 89 627 200 980) provides building science consultancy services including:

• NatHERS Assessments — Nationwide House Energy Rating Scheme assessments for residential buildings
• Passive House Certification — Certification and consultancy for Passive House standard projects
• Section J Reports — Energy efficiency compliance reports for commercial buildings under the National Construction Code
• Thermal Modelling — Detailed thermal performance analysis and modelling for building projects

All services are provided by qualified professionals. The scope and deliverables for each engagement will be agreed upon prior to commencement.

3. Booking & Payment Terms

We offer consultation bookings in the following formats:

• 30-minute initial consultation — Free of charge, intended to scope project requirements
• 60-minute consultation — Paid consultation, billed at the rate displayed at time of booking
• 90-minute consultation — Extended paid consultation, billed at the rate displayed at time of booking

All paid consultations are processed securely through Stripe. Payment is required at the time of booking to confirm your appointment. Prices are in Australian Dollars (AUD) and include GST where applicable.

Cancellations made more than 24 hours before the scheduled consultation will receive a full refund. Cancellations within 24 hours may not be eligible for a refund. We understand things come up — if you need to reschedule, please get in touch as early as possible.

4. Digital Downloads

Building Physics Australia offers digital products including templates, tools, and resources for thermal modelling and building science. By purchasing a digital product, you acknowledge:

• Digital downloads are non-refundable once the product has been delivered or accessed
• Products are licensed for your personal or professional use only
• You may not redistribute, resell, or share purchased products without written permission
• We reserve the right to update or modify products; updates will be available to existing purchasers where possible

If you experience issues accessing a purchase, please contact us and we will assist you promptly. We want you to get value from every product you buy.

5. Professional Disclaimer

Our consulting services are provided based on the information available at the time of engagement. While we strive for accuracy and thoroughness, our advice and deliverables should be used in conjunction with other professional advice and in compliance with local building codes and regulations.

6. Intellectual Property

All content, materials, tools, templates, and resources provided by Building Physics Australia remain our intellectual property. This includes but is not limited to website content, consultation materials, digital products, and methodologies.

You may not reproduce, distribute, modify, or create derivative works from our materials without explicit written permission. Custom reports and assessments produced for your project are licensed for your use in relation to that specific project.

7. Limitation of Liability

Building Physics Australia provides professional consultancy and resources in good faith. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential losses arising from the use of our services or digital products
• Our total liability for any claim is limited to the amount paid for the specific service or product in question
• We do not guarantee specific outcomes from consultations or the application of our tools and templates
• You are responsible for ensuring compliance with all applicable building codes, regulations, and standards for your project

8. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded or limited.

9. Privacy

We take your privacy seriously. Our collection and handling of personal information is governed by our Privacy Policy and complies with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

10. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

11. Changes to These Terms

We may update these terms from time to time. Any changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
